Terms and Conditions of Hire
Koala Mobile Skips Pty Ltd
Version: 19 October 2026 | Governing law: Victoria, Australia
IMPORTANT: These Terms form the agreement between Koala Mobile Skips and the Customer. They include important obligations concerning asbestos, prohibited waste, additional charges, access, surface damage and liability. Read them before booking. If you are unsure whether material may contain asbestos, do not place it in the Skip Bin and obtain appropriate advice or testing.
1. Definitions and interpretation
In these Terms:
- Customer, you or your means the person or entity that makes the Booking, pays for the Services, accepts delivery, uses the Skip Bin, or on whose behalf the Booking is made.
- Booking means a request for Services accepted by Koala Mobile Skips, whether made online, by telephone, by email or otherwise.
- Hire Period means the agreed period during which the Customer may use the Skip Bin.
- Koala Mobile Skips, we, us or our means Koala Mobile Skips Pty Ltd.
- Services means delivery, hire, collection, transport and lawful disposal services supplied by us.
- Skip Bin means the mobile skip bin, trailer, lock and related equipment supplied by us.
- Waste means every item, substance or material placed in or associated with the Skip Bin.
- Prohibited Material means any item listed in clause 5 or otherwise prohibited by law, a disposal facility, or these Terms.
Headings do not affect interpretation. A reference to legislation includes amendments and replacements. Dollar amounts are in Australian dollars. “Including” does not limit the words that precede it.
2. Agreement and acceptance
- These Terms apply to every Booking and use of the Services.
- A contract is formed when we accept your Booking. You accept these Terms by ticking the acceptance box online, making payment, accepting delivery, or using the Skip Bin.
- You warrant that you are at least 18 years old and have authority to enter into this agreement and, if booking for another person, business, property owner or site, to bind that party.
- The Booking confirmation, selected waste type, price, Hire Period, weight allowance, delivery instructions and any written variations form part of this agreement.
- If there is an inconsistency, a written variation expressly agreed by us prevails, followed by the Booking confirmation, then these Terms.
- Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
3. Hire Period and extensions
- Standard hire includes four (4) days and three (3) nights, unless the Booking confirmation states otherwise.
- Additional hire is charged at $30 per day unless otherwise agreed in writing.
- An extension must be requested before the scheduled collection date and is subject to availability. An extension is not confirmed until accepted by us.
- The Skip Bin must be accessible and ready for collection by the agreed collection date and time window.
- If the Skip Bin is not ready or accessible, additional hire, waiting, re-attendance, transport and administration charges reasonably incurred may apply.
4. Waste types and permitted use
- The Skip Bin may only be used for the waste type selected in the Booking. Mixing waste types or placing a different waste type in the Skip Bin may result in reclassification and additional disposal charges.
4.1 General Waste
General Waste is intended for household clean-ups and light commercial waste, including furniture, clothing, toys, plastics, cardboard, packaging and similar non-hazardous items. Bricks, concrete, soil, tiles and builders rubble are not permitted in a General Waste booking.
4.2 Builders Waste
Builders Waste is intended for approved construction and demolition materials such as bricks, concrete, tiles and rubble, subject to the Booking description, weight allowance and all asbestos requirements in these Terms. Soil is prohibited and must not be placed in the Skip Bin.
4.3 Green Waste
Green Waste is limited to garden organics such as grass, leaves, branches and tree clippings. Soil, treated or painted timber, plastic bags, food waste, general rubbish and Prohibited Material are not permitted.
- If you are uncertain whether an item is allowed, you must contact us before placing it in the Skip Bin. Our acceptance of a Booking does not amount to confirmation that every item in your load is permitted.

- The following materials are strictly prohibited and must not be placed in the Skip Bin:
- Asbestos, suspected asbestos, asbestos-containing material (ACM), fibro or material that may reasonably contain asbestos.

- Explosives, flammable goods, dangerous goods and radioactive material.
- Clinical, medical, pharmaceutical or biological waste.

- Restricted item fees may change where disposal facility charges change, but the fee shown in and accepted through the Booking will apply to that Booking unless the item was not disclosed or was incorrectly described.
6. Asbestos and hazardous material obligations
- You warrant that no asbestos, suspected asbestos, ACM, fibro, hazardous waste or dangerous goods will be placed in or around the Skip Bin.
- If Waste originates from renovation, demolition, roofing, fencing, wet-area work, or a building or structure that may contain asbestos, you are responsible for obtaining appropriate professional advice or testing before placing the Waste in the Skip Bin.
- If you are uncertain whether material contains asbestos, you must treat it as suspected asbestos, keep it out of the Skip Bin and notify us immediately.
- If asbestos or another hazardous material is suspected or identified, we may, where reasonably necessary for safety or legal compliance:
- refuse delivery or collection;
- stop work or suspend the Services;
- secure, isolate or quarantine the Skip Bin or affected area;
- require the Customer to engage a licensed specialist;
- arrange inspection, sampling, testing, transport, decontamination, remediation or lawful disposal; and
- notify the property owner, disposal facility, insurer, emergency service or regulator where required or reasonably appropriate.
- To the extent caused by Waste placed in or associated with the Skip Bin by you or any person for whom you are responsible, you are liable for the reasonable, documented costs arising from asbestos or hazardous material contamination. These may include testing, classification, specialist contractors, personal protective equipment, quarantine, transport, disposal, decontamination, site clean-up, remediation, equipment cleaning or replacement, regulatory compliance, storage, re-attendance, legal and professional costs, and loss of use of the affected Skip Bin or trailer.
- You indemnify us and our directors, employees, contractors and agents against third-party claims, loss, liability, damage, fines, penalties and reasonable costs arising from asbestos, ACM, hazardous material or dangerous goods introduced by you or a person for whom you are responsible, except to the extent caused or contributed to by our negligence, breach of contract or unlawful act.
- The obligations in this clause survive collection, disposal, completion or termination of the Services.
7. Customer declaration
When making a Booking, you declare, warrant and acknowledge that:
- the information supplied about the Waste, property, work and site is complete and accurate;
- you have checked the proposed load and no asbestos, suspected asbestos, ACM, fibro, hazardous substance or other Prohibited Material will be placed in the Skip Bin;
- if you become uncertain about any material, you will not load it and will contact us before proceeding;
- we may rely on your answers and declarations when accepting the Booking; and
- you accept responsibility for persons who access or load the Skip Bin with your permission, at your site, or on your behalf.
8. Weight allowances and overweight charges
- The included weight allowances are:
- General Waste 4m3: 500kg.
- Builders Waste 4m3: 1,000kg.
- Green Waste 4m3: 500kg.
- Additional weight is charged at $45 per 100kg, calculated proportionately at $0.45 per kilogram, unless the Booking states otherwise.
- Weight is determined using the disposal facility record, weighbridge record, onboard weighing system or another reasonable measurement method available to us.
- Overweight charges reflect additional disposal and handling costs and are payable in addition to the hire fee and any contamination or re-attendance charges.
9. Loading, safety and overloading
- Waste must be contained wholly within the Skip Bin and must not extend above the top rim or protrude over the sides.
- You must distribute weight safely, close and secure lids where fitted, and comply with our reasonable safety directions.
- You must not climb into, burn material in, modify, tow, move, lift or interfere with the Skip Bin or trailer.
- We may refuse collection of a Skip Bin that is overloaded, unsafe, inaccessible or non-compliant. You must remove or rectify the affected material at your cost before collection.
- If re-attendance is required, you must pay the reasonable additional hire, driver, transport, waiting and administration costs incurred and disclosed to you.
10. Delivery, access and placement
- You must provide complete and accurate delivery details and clear, lawful and safe access for delivery and collection, including sufficient width, height, turning space and ground stability.
- You are responsible for obtaining any council, road, body corporate, landlord, property owner or other approval required for placement, unless we expressly agree otherwise in writing.
- The driver may refuse a requested placement where it is unsafe, unlawful, inaccessible or presents an unreasonable risk to people, property, vehicles, equipment or services.
- If delivery or collection cannot be completed because of blocked access, parked vehicles, locked gates, incorrect instructions, unsafe conditions or another circumstance within your control, you are responsible for reasonable waiting, re-attendance, additional hire and transport costs notified to you.
- Delivery and collection times are estimates unless expressly guaranteed in writing. We are not responsible for delay caused by traffic, weather, mechanical failure, disposal facility restrictions, unsafe conditions or events beyond our reasonable control, but we will provide the Services within a reasonable time.
11. Placement on driveways and other surfaces
- At your request, the Skip Bin may be placed on a driveway, paving, concrete, asphalt, lawn or another surface nominated by you.
- You must tell us before delivery if the surface is new, decorative, cracked, thin, waterlogged, sloped, unstable, subject to underground services or otherwise vulnerable.
- You acknowledge that heavy equipment can mark, indent, rut, scratch or damage surfaces. To the maximum extent permitted by law, we are not liable for surface damage that results from following your placement instruction where we have exercised reasonable care and the damage was not caused by our negligence or breach of contract.
- You are responsible for identifying underground services, irrigation, drainage, pits, septic systems and other hidden infrastructure at the placement area.
12. Security, lock and care of equipment
- The Skip Bin may be supplied with a lock and access code. You must secure it when unattended and take reasonable steps to prevent unauthorised access or dumping.
- A $25 replacement fee applies if a supplied lock is lost or damaged, or if the code is changed without our agreement.
- The Skip Bin and trailer remain our property at all times. You do not acquire any ownership or other interest in the equipment.
- You are responsible for loss of or damage to our equipment while it is at your site, except for fair wear and tear or loss or damage caused by us.
13. Ownership and responsibility for Waste
- Ownership of, and responsibility for, all Waste placed in or associated with the Skip Bin remains with the Customer at all times, including during loading, storage, collection and transport, and until the Waste has been lawfully accepted and disposed of by an authorised waste facility.
- You remain responsible for the Waste description, classification, legality and contents and for complying with these Terms and applicable law.
- Our possession, collection or transport of the Waste does not amount to acceptance that the Waste is permitted, correctly classified, safe or free from contamination.
- If a disposal facility rejects or reclassifies the Waste, you remain responsible for the reasonable resulting costs, including return transport, storage, further handling, testing and lawful disposal, to the extent the rejection or reclassification results from the Waste supplied by you or incorrect information you provided.
14. Inspection, photographs and records
- We may inspect and photograph the Skip Bin, Waste, load level, access route and placement area where reasonably required for service delivery, safety, compliance, evidence, billing or dispute resolution.
- We may retain Booking responses, acceptance records, time stamps, photographs, disposal records, weighbridge records and communications in accordance with applicable privacy and record-keeping obligations.
- Photographs and records may be used as evidence of the condition, location, contents and loading of the Skip Bin, but do not prevent either party from providing other relevant evidence.
15. Prices, payment and additional charges
- Unless stated otherwise, prices shown to consumers include GST. Business quotations may state GST separately.
- Online and telephone Bookings must be paid in full before delivery unless we approve an account in writing.
- Approved account customers are invoiced on seven (7) day payment terms unless the invoice states otherwise.
- You authorise us to charge the payment method provided for the Booking price and reasonable additional amounts payable under these Terms, including additional hire, overweight, disclosed restricted items, reclassification, contamination, testing, disposal, waiting, re-attendance, equipment damage and lock replacement.
- Before or promptly after processing an additional charge, we will provide an itemised explanation and supporting information reasonably available to us. This does not prevent urgent action needed for safety or legal compliance.
- You must not initiate a chargeback for a valid charge without first contacting us and giving us a reasonable opportunity to investigate. This clause does not limit any legal right to dispute a transaction.
- Amounts not paid when due may be recovered as a debt. You are responsible for reasonable external debt recovery and legal costs actually incurred, to the extent permitted by law.
16. Cancellation, rescheduling and refunds
- A Booking cancelled more than 48 hours before the scheduled delivery is refundable less a $50 administration fee.
- A Booking cancelled within 48 hours of scheduled delivery is non-refundable to the extent we have incurred costs or reserved resources that cannot reasonably be reallocated. Any greater amount required by law will be refunded.
- A rescheduling request is subject to availability. Additional costs already incurred may be payable.
- If we cancel and cannot provide a reasonable alternative, we will refund amounts paid for Services not supplied, subject to any rights and remedies available under law.
17. Liability and indemnity
- Nothing in these Terms excludes, restricts or modifies liability that cannot lawfully be excluded, including liability under the Australian Consumer Law.
- To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the contract was made.
- You are responsible for loss, damage, liability and reasonable cost arising from your breach of these Terms, your negligent or unlawful act or omission, or Waste introduced by you or a person for whom you are responsible.
- You indemnify us and our directors, employees, contractors and agents against third-party claims and reasonable loss or cost arising from the matters in clause 17.3, except to the extent caused or contributed to by our negligence, breach of contract or unlawful act.
- Any limitation or indemnity in these Terms is to be read down to the extent necessary to be valid and enforceable.
18. Privacy and communications
- We may collect, use and disclose personal information as reasonably necessary to process the Booking, deliver the Services, take payment, manage safety and compliance, communicate with you, investigate incidents and resolve disputes.
- We may send Booking confirmations, terms, declarations, invoices, receipts, service notifications and other transactional communications electronically to the contact details you provide.
- You must ensure your contact details are accurate and notify us of any relevant change.
19. Complaints and disputes
- If you have a concern about the Services or a charge, contact us promptly using the details in clause 23 and provide the Booking number and relevant information.
- Both parties will act reasonably and attempt in good faith to resolve the dispute before commencing proceedings, except where urgent relief is required or a limitation period may expire.
- Nothing in this clause prevents you from contacting Consumer Affairs Victoria, the Australian Competition and Consumer Commission, a court, tribunal or another regulator or dispute-resolution body.
20. Events beyond reasonable control
- A party is not liable for delay or failure caused by an event beyond its reasonable control, provided it takes reasonable steps to minimise the effect and resumes performance when reasonably possible.
- This clause does not excuse payment for Services already supplied or costs already and reasonably incurred.
21. Variation, severability and waiver
- A variation to a confirmed Booking must be agreed in writing or recorded in the updated Booking confirmation.
- We may update these Terms for future Bookings. The version accepted when a Booking is made applies to that Booking unless both parties agree otherwise or a change is required by law.
- If part of these Terms is invalid or unenforceable, it is to be read down where possible and otherwise severed without affecting the remaining provisions.
- A delay or failure to exercise a right is not a waiver of that right.
22. Governing law
- These Terms are governed by the laws of Victoria, Australia.
- Subject to any law allowing proceedings elsewhere, the parties submit to the courts and tribunals of Victoria.
